Built Prefab Semi-Custom Design Package Terms and Conditions – Matt Kokan (“Pender Harbour”)

Project Location: 13256 PENDER LANDING RD, GARDEN BAY, BC  V0N 1S1 (LOT 27)

1. Scope of Work

Built Prefab Corporation (“Built Prefab”) agrees to provide semi-custom design services based on the 2025 Meadow model. The design modifications include:

• Start with the 2025 Meadow floorplan oriented to the water view
• Minimal floorplan, door/window layout modifications, per Owner
• ICF crawlspace foundation 
• Large back deck across rear elevation on waterside 
• Two car detached garage 
• Site Plan per Owner ; topo survey completed and available 
• Finish material selections per Built Prefab standards 
• Possibly using mass timber (CLT) components, per Owner

2. Fees and Payment Terms

• Total Fee: $8,000.00 (CAD) plus applicable taxes
• Payment Due: Upon acceptance of this Agreement
• Design Iterations Included: Three (3)
  • Additional iterations requested by the client will be billed at the greater of $500 per change or $125 per hour, whichever is greater

3. Project Phases

a. Choice of Plan and Scope of Redesign

• Starting point: 2025 Meadow

b. Project Code and Site Feasibility Analysis

• Investigation of applicable building codes and municipal restrictions
• Assessment of site conditions affecting design and construction
• Deliverables:
  • Smartsheet with all relevant information
  • Integration of site and code requirements into building plans

c. Conceptual Design and Estimate

• Commencement of design process post site feasibility analysis
• Deliverables:
  • Semi-custom floorplan
  • 3D interior and exterior elevations
  • Preliminary site plan
  • Preliminary project budget (±10%)
  • High-resolution images

4. Additional Fees and Exclusions

The following services are not included in this agreement and may incur additional fees, which will be detailed in a separate production or site agreement:

• Permitting submission project management time
• Land titles or other registry searches
• Foundation and structural engineering
• Permit fees
• Energy advisor fees
• City development cost charges
• Utilities and services charges
• Geotechnical engineering
• Site survey

Work required due to additional municipal requirements (e.g., development permits, rezoning, strata submissions) will be billed at $125 per hour. Expenses incurred on your behalf will be billed at actual cost plus 15%.

5. Client Responsibilities

• Provide timely feedback and necessary information to facilitate the design process
• Obtain required permissions or approvals from third parties (e.g., homeowner associations, strata councils)

6. Limitation of Liability

• Built Prefab is not liable for indirect, incidental, or consequential damages arising from this agreement
• Total liability shall not exceed the fees paid under this agreement

7. Governing Law

• This agreement is governed by the laws of the Province of British Columbia, Canada
• Parties agree to submit to the exclusive jurisdiction of British Columbia

8. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to this agreement, the parties agree to undertake the resolution of such dispute, controversy or claim through a med-arb process.

9. Entire Agreement

• This document constitutes the entire agreement between the parties
• Supersedes all prior discussions or agreements

10. Amendments

• Any changes to this agreement must be made in writing and signed by both parties
